What is the INS and/or the Justice Department position on the following questions?
- If we do not ask (about immigration status) we cannot tell, therefore, does existing law (current enforcement and/or interpretation) put a specific burden on citizens to determine the legal resident status of others?
- If the legal resident staus is determined to be in question by a citizen, does existing law (current enforcement and or interpretation) put a specific burden on citizens to report to the INS?
Answers:
- Private citizens are not responsible to determine people’s legal status.
- Citizens are not responsible to report undocumented people.
